Terms of Service

Last updated: 12 October 2026 · Version 1.2

Kepler Study is operated by Neo Setungoane, South Africa ("Kepler", "we", "us"). Contact: keplerstudy@gmail.com.

Welcome to Kepler Study. These Terms of Service ("Terms") govern your access to and use of the Kepler Study application and its related services. By creating an account or using Kepler, you agree to be bound by these Terms. If you do not agree with these Terms, you should not use Kepler.

1. Services

Kepler provides educational and study-support tools intended to help university students organise their learning and prepare for assessments.

Our services may include study notes, practice questions, progress tracking, study sessions, educational resources, reminders, search tools, study materials you upload, audio recording of lectures, and other features introduced in future versions.

Features may be changed, updated, suspended or discontinued as Kepler develops.

Kepler is a study-support platform and is not a university, examination authority, academic institution or official representative of any university unless explicitly stated.

2. Account

Some Kepler features require you to create an account. You must be at least 18 years old to create an account and use Kepler.

You are responsible for providing accurate information and keeping your account information up to date.

You are responsible for maintaining the security of your account and should not share your login credentials with other people.

You are responsible for all activity carried out through your account, whether or not you authorised it.

If you believe that your account has been accessed without your permission, contact Kepler support as soon as possible.

3. Requirements and Restrictions

You must use Kepler only for lawful purposes and in accordance with these Terms.

You must not attempt to interfere with, damage, reverse engineer, disrupt or gain unauthorised access to Kepler or its underlying systems.

You must not use Kepler to distribute malicious software, spam, harmful material or content that violates the rights of others.

You must not copy, reproduce, redistribute or commercially exploit Kepler content except where you have permission or applicable law allows you to do so.

You must not attempt to circumvent security measures, access restrictions, moderation tools or other technical protections used by Kepler.

4. User Inputs and Outputs

You may provide information, questions, feedback, preferences and other material to Kepler ("Inputs").

You remain responsible for the Inputs you provide and must have the necessary rights to provide them.

Kepler may generate, display or provide information, recommendations, explanations, questions and other material in response to your Inputs ("Outputs").

Outputs are provided for educational and informational purposes and should be reviewed for accuracy before being relied upon.

You should not submit confidential, highly sensitive or unnecessary personal information into features where such information is not required.

5. AI-Generated Content and Services

Certain Kepler features may use artificial intelligence or machine-learning technologies to generate study material, feedback, explanations, questions or other outputs.

AI-generated content can contain errors, omissions, outdated information or misleading statements. It should not automatically be treated as authoritative or correct.

You are responsible for verifying important academic information against your course material, lecturers, textbooks, official university resources or other reliable sources.

AI features are intended to support learning and are not a replacement for lecturers, tutors, academic advisors or professional services.

Kepler does not guarantee that AI-generated content will always be accurate, complete, appropriate or suitable for a particular academic requirement.

6. Academic Integrity

Kepler is intended to support legitimate learning and academic preparation.

You remain solely responsible for complying with your university's academic integrity policies, assessment rules and examination regulations.

Kepler must not be used to facilitate cheating, plagiarism, impersonation, unauthorised collaboration or any other form of academic misconduct.

You must not submit work generated, assisted or informed by Kepler as your own if doing so would breach your institution's rules on the use of AI tools, third-party assistance or unauthorised aids.

The availability of study materials in Kepler does not guarantee that specific material will appear in an examination or assessment.

7. Educational Content

Study materials are provided to support learning and revision.

Kepler does not guarantee that educational content is complete, error-free, current or aligned with every university's curriculum.

Where appropriate, students should compare Kepler materials with official course outlines, prescribed resources and instructions from their institution.

8. Your Uploaded Material (Notes, Slides, Past Papers, Summaries)

Kepler allows you to upload notes, summaries, lecture slides, textbook extracts, past papers, recordings and other study materials for your own personal study use ("User Content"). Your User Content is private to your account. Kepler does not make it available to other users.

You are solely responsible for the User Content you upload. Kepler does not verify the ownership, accuracy, origin or lawfulness of User Content before it is stored or processed, and storing it in Kepler does not mean Kepler endorses it.

By uploading User Content, you confirm and warrant that you either own the material, have the copyright holder's permission to use it, or are otherwise legally entitled to upload it and use it for your personal study under applicable law.

You must not upload material that infringes another person's copyright or intellectual property. This includes, without limitation, lecture slides, lecture recordings, textbooks, prescribed readings, past examination papers, memoranda, study guides or course packs that you do not personally own or have permission to use. It is your responsibility, not Kepler's, to determine whether you have the right to upload a file before you upload it.

You must not upload material obtained from piracy sites, file-sharing networks, essay mills, unauthorised 'study banks' or any other source that does not itself have the right to distribute it.

You must not upload material that is confidential, that breaches your university's academic or copyright policies, that contains another person's personal information without their consent, or that is unlawful, defamatory, harmful or otherwise objectionable.

By uploading User Content, you grant Kepler a non-exclusive, worldwide, royalty-free licence to host, store, reproduce and technically process that material, including by sending it to our AI providers, solely to provide Kepler's services to you. You retain ownership of your User Content.

Kepler may review, restrict, hide or permanently remove any User Content at its discretion, including in response to a copyright complaint, an instruction from a university or rights holder, or any other reasonable concern, without advance notice. Kepler may suspend or terminate accounts that repeatedly upload infringing content.

If you are a rights holder and believe material stored in Kepler infringes your rights, email keplerstudy@gmail.com with details of the material and your claim, and we will review it and, where appropriate, remove it.

You agree to indemnify and hold harmless Kepler, to the extent permitted by applicable law, against any claims, losses, liabilities, damages or costs (including reasonable legal fees) arising from User Content you submit that infringes another person's rights or breaches these Terms.

9. Lecture Recordings and Audio Capture

Kepler allows students to record lectures, tutorials, study sessions and other audio using the recording feature in the app.

You are solely responsible for ensuring that any recording you make is lawful and complies with all applicable rules. This includes your university's policies on recording, your lecturer's or tutor's instructions, applicable privacy and data-protection laws, and any consent requirements that apply in your jurisdiction.

Many universities require the express permission of the lecturer and/or the students present before a lecture may be recorded. It is your responsibility to find out what the rules are and to obtain any consent or permission required before you press record. Kepler does not obtain that consent for you.

You must not use the recording feature to record other people, including lecturers or fellow students, in circumstances where they have not consented to being recorded, or where doing so would breach their privacy, confidence or any applicable law.

You must not use the recording feature to capture material that you are not entitled to record, to record in closed, confidential or restricted sessions, or to record in a way that interferes with the lecture or disrupts other students.

Recordings are stored for your personal study use within Kepler. You are responsible for how you use, share or dispose of them. You must not publish, redistribute or share recordings of lectures or of other people without all necessary permissions.

Kepler does not monitor recordings, does not check them for legality or consent, and does not accept responsibility for any recording made in breach of a university rule, an individual's privacy rights or the law. Such recordings are made entirely at your own risk, and you accept full responsibility for them.

You agree to indemnify and hold harmless Kepler, to the extent permitted by applicable law, against any claims, losses, liabilities, damages or costs arising from recordings you make using the app that breach these Terms, your university's policies, or any applicable law.

10. Progress Tracking, Mastery Percentages and Study Metrics

Kepler displays mastery percentages, progress indicators, streaks, review reminders and other study metrics to help you understand your own study activity and revision status.

These metrics are diagnostic study aids only. They measure how you have interacted with the material inside Kepler — for example, how well you explained a concept in your own words, how recently you reviewed a topic, or how many practice questions you answered.

A high mastery percentage does not mean, and is not a prediction of, a high mark in a university test, exam, assignment or module. It does not account for factors that affect your actual academic performance, including but not limited to the actual exam content, the marking rubric, time pressure in the exam room, your physical and mental state on the day, the depth of the examiner's questions, or your university's assessment standards.

Similarly, a lower mastery percentage does not mean you will fail, and a high mastery percentage does not mean you will pass. Mastery metrics measure your internal understanding of concepts as assessed by the app — nothing more and nothing less.

Progress, mastery and streak metrics reset, adjust or evolve over time as you study, and are not a substitute for attending lectures, working through official course material, or preparing for your assessments as your university requires.

Kepler is not affiliated with, endorsed by or acting on behalf of your university's assessment processes, and these metrics have no official academic standing of any kind.

11. No Guarantee of Academic Outcomes

Kepler does not and cannot guarantee any specific academic outcome.

Use of Kepler does not guarantee that you will pass a test, examination, assignment or module, nor that you will achieve any particular mark, grade, distinction or classification.

Your actual academic results depend on many factors outside Kepler's knowledge or control, including the content of your assessment, how it is marked, your own preparation, the quality of your understanding, and your performance on the day.

Kepler expressly does not guarantee any specific grade, pass rate, distinction or academic outcome, and is not responsible for academic results that differ from what Kepler's study metrics, mastery percentages or feedback may have suggested.

12. Intellectual Property

Kepler's software, interface, branding, design, original written content and other proprietary materials are protected by applicable intellectual-property laws.

You may use Kepler content for your personal educational purposes subject to these Terms.

You may not reproduce, modify, distribute, sell or commercially exploit proprietary Kepler materials without appropriate permission.

Third-party materials, including your User Content, remain subject to the rights of their respective owners.

13. Third-Party Services and Content

Kepler may rely on third-party services, platforms, APIs, authentication providers, cloud infrastructure, AI providers or other technologies.

Third-party services may have their own terms, privacy policies and availability requirements.

Kepler is not responsible for independent third-party services or content that is outside Kepler's control.

14. Complaints, Reports and Feedback

We welcome feedback, suggestions, complaints and reports about problems with Kepler, including reports about User Content, recordings or any behaviour that may breach these Terms.

Feedback may be used to improve, develop or evaluate Kepler and its services.

Submitting feedback does not guarantee that Kepler will implement a particular suggestion.

If you believe that content, functionality or another user's behaviour is incorrect, inappropriate or infringing your rights, please contact Kepler through the available support channels.

15. Privacy

Your use of Kepler may involve the collection and processing of information necessary to provide the service, including account information, study activity and content you upload.

Our Privacy Policy explains how information is collected, used, stored and protected.

By using Kepler, you acknowledge that your information may be handled in accordance with the Privacy Policy.

16. Disclaimer of Warranties

Kepler is provided on an 'as is' and 'as available' basis to the extent permitted by applicable law.

We do not guarantee that Kepler will always be available, uninterrupted, secure or free from errors.

We do not guarantee the accuracy, completeness or reliability of educational, AI-generated, uploaded or other information provided through the service.

Your use of Kepler is at your own discretion and risk.

17. Limitation of Liability

To the maximum extent permitted by applicable law, Kepler and its developers will not be liable for indirect, incidental, consequential, special or punitive losses arising from your use of, or inability to use, the service.

This includes, where legally permitted, losses relating to academic results, exam grades, distinctions or other outcomes, missed assessments, loss of data, interruptions, reliance on educational, AI-generated or uploaded content, recordings, or decisions made based on information provided by Kepler.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.

18. Indemnity

To the extent permitted by applicable law, you agree to be responsible for claims, losses, damages and reasonable costs arising from your misuse of Kepler, your violation of these Terms, your violation of applicable law, User Content you submit, recordings you make, or your infringement of another person's rights.

19. Suspension and Termination

We may suspend or terminate access to Kepler where reasonably necessary, including where an account violates these Terms, creates a security risk, uploads infringing User Content, breaches recording or privacy rules, or is used for unlawful or abusive activity.

You may stop using Kepler at any time.

Termination does not remove obligations that by their nature should continue after termination, including ownership, indemnity and limitation of liability provisions.

20. Changes to Kepler

Kepler may be updated, modified or expanded over time.

We may introduce new features, remove features, change functionality or make technical improvements.

Continued use of Kepler after material changes to these Terms may constitute acceptance of the updated Terms where permitted by law.

21. Changes to These Terms

These Terms may be updated from time to time to reflect changes to Kepler, applicable law or our services.

The 'Last updated' date at the top of this page indicates when the Terms were most recently revised.

Where appropriate, significant changes may be communicated through the application or another reasonable method.

22. Governing Law

These Terms are governed by the laws of the Republic of South Africa, subject to any mandatory consumer protections that apply to you in the country where you live.

23. Subscriptions, Billing and Refunds

Kepler offers a free plan and paid subscription plans (currently Standard and Premium). Paid plans are billed monthly, and Premium is also available billed yearly. The price and billing period of each plan are shown in the app and on our About & Pricing page before you buy.

Payments are processed by Paddle.com, our Merchant of Record. Paddle handles the payment, applicable taxes and invoices, and its own terms apply to the payment transaction. Your statement may show Paddle as the seller.

Paid plans renew automatically at the end of each billing period, and you are charged the then-current price until you cancel.

You can cancel at any time from Subscription > Manage or Cancel Subscription in the app. After you cancel, you keep your paid features until the end of the period you have already paid for, and you will not be charged again.

Refunds are handled under our Refund & Cancellation Policy, which forms part of these Terms.

We may change plan prices or features for future billing periods. We will give reasonable notice of price changes, and they apply from your next renewal.

If a payment fails or a subscription ends, your account returns to the free plan and the limits of the free plan apply.
